Are smileys copyrighted?

I like the smileys included in the zip file for 1.6. They look like identical copies of those included in Microsoft's various Messenger products.

Are they exact copies (screen captures or whatever)?

Do you have permission from the icon's creators to distribute them under the LGPL? For example, are the public domain or previously released under a license that is LGPL compatible?
