Unwanted &nbsp; added between p tags, <p>

I've tried dataProcessor for fixing this problem, however, it doesn't work.
i looked through this forum,
someone suggest change the source code, but i dont think it's a good way to do that. . .
(in fact , it doesn't work too)

is there any ways to remove the &nbsp; when i created an empty paragraph?

to reproduce this issue,

1. By using <p contentediable="false" unselectable="on"> for lock text
2. at the end of the lock text line, press enter,
3. totally two lines are created rather than one line
4. view source code, one more <p>&nbsp;</p> is added.
So the code will like this: 
<p contentediable="false" unselectable="on">lock text</p>
<p>&nbsp;</p>
<p></p>


what i want like this: 
<p contentediable="false" unselectable="on">lock text</p>
<p></p>


anyone encounter should a problem ?

This issue seems to be working fine in latest CKEditor 3.6.2
